New multi-family or non-residential buildings or site developments within the
City of Milpitas require site and architectural review by the Planning
Commission before any building permits are issued. This is referred to as the
site and architectural or "S" Zone Approval process. (see Zoning
Ordinance Section 42)
Summary of the "S" Zone Approval Process:
- Contact the Planning Division to discuss your project. A preliminary
meeting is helpful in identifying issues and understanding the process.
- Submit all requested information at one time to the Planning Division.
Planning Staff will determine the date your project will go before the
Planning Commission for a decision.
- Typically a new building will take approximately six to eight weeks from
the time the project is submitted, with all the requested information, to
the Planning Commission meeting date. Planning Staff will collect comments
regarding your project from other City Departments and write a report on the
project for the Planning Commission which will be discussed at the Planning
Commission meeting. The report will include Planning Staff's recommendation
(e.g. approval or denial).
- The Planning Commission makes their independent decision based on all the
information and testimony provided during the public hearing. All decisions
by the Planning Commission may be appealed to the City Council.
