Megan's Law

Picture of a flower The Milpitas Police Department is committed to keeping its community as safe as possible. The Milpitas Police Department has made available for public viewing a computer database of registered sex offenders. This database is maintained by the California Department of Justice and is located in the Police Department lobby. The public viewing hours are Monday through Friday, from 9:00 a.m. to 12:00 p.m. and Saturday and Sunday, by appointment only, contact the Watch Commander at 586-2405. The following are requirements for eligibility to view the database:
  1. The applicant shall provide a California driver's license or California identification card showing that the applicant is at least 18 years of age. Applicants who are active members of the Military need not present a California ID card or Driver’s License to view the database. Proof of assignment or a Military ID will suffice.
     
  2. The applicant shall also sign the Request to Review Sexual Offender Identification Information form (provided in Lobby), stating a purpose in order to have access, and attesting that (s)he understands the purpose of the release of information is to allow members of the public to protect themselves and their children from sex offenders, and that he or she understands it is unlawful to use information obtained from the CD-ROM or other electronic medium to commit a crime against any registrant or to engage in illegal discrimination or harassment of any registrant.

The Special Investigations Unit (SIU) sergeant coordinates the Milpitas Police Department's responsibilities with respect to Megan's Law. Any concerns or questions regarding Megan's Law or other SIU related matters should be directed to the SIU sergeant at (408)586-2504.

Megan's Law History

In 1995, a convicted child molester was arrested for the murder and rape of 7 year-old Megan Kanka in a New Jersey suburb. The offender lived right accross the street from the Kanka residence, hewever the Police Department was prohibited from disclosing the presence of this child molester because at the time the law did not allow the release of sex offender information to the public.

The law, dubbed "Megan's Law" was changed to permit the release of this information to the public. California's version of Megan's Law went into effect on September 25, 1996. This law was implemented to allow potential victims to protect themselves and allow parents to protect their children.

Please be aware that specific provisions of California's Megan's Law make it a crime to use this information to harass or commit a criminal act against another person, including previously convicted sex offenders. The map does not reflect the locations of registrants known to be incarcerated, registrants that are transient with no associated address, and registrants with unknown addresses.

PLEASE NOTE: The placement of the symbols depicting sex offenders' whereabouts have been intentionally offset to the center of a Census unit to prohibit an exact location from being determined by viewing the map on this website.

The amp on this website dosplays the general whereabouts of registered sex offenders, classified as either "Serious" or "High Risk". It does not depict the actual location of any registrant's residence. The registered sex offender information used on this website is provided by the California Department of Justice and Milpitas Police Department Records.

Classification of Sex Offenders

"High Risk"
High-risk sex offenders have been convicted of multiple violent offenses including at least one crime of a sexual nature. Certian information regarding high-risk sex offenders is subject to public disclosure.

"Serious"
Serious sex offenders are those that have been convicted of a felony sex crime or misdemeanor child molestation. Certian information regarding serious sex offenders is subject to public disclosure.

"Other"
Other sex offenders have been convicted of misdemeanor crimes such as pornography, indecent exposure, sexual battery, or crimes committed as a juvenile and adjudicated in juvenile court. Certian information regarding other sex offenders is not subject to public disclosure.

The Megan's Law database is available for public viewing Monday through Friday from 9:00 AM to Noon, and Saturday and Sunday from 4:00 PM to 6:00 PM. It is located in the Milpitas Police Department Lobby.
