NOTICE IS HEREBY GIVEN that the Milpitas City Council will hold a public hearing on Tuesday, April 16, 2019,
at 7:00 PM in City Hall Council Chambers, 455 E. Calaveras Blvd., 2nd floor, Milpitas, CA on the following topic:
INTRODUCTION OF ORDINANCE NO. 38.833 AMENDING SECTION 2 (“DEFINITIONS”), SECTION 4
(“RESIDENTIAL USES”), SECTION 13 (“SPECIAL USES”), AND SECTION 57 (“APPLICATIONS”) OF THE ZONING
CODE TO COMPLY WITH GOVERNMENT CODE SECTIONS 65852.2 AND 65852.22 TO FURTHER ENCOURAGE
THE PRODUCTION OF ACCESSORY DWELLING UNITS AND MAKE A DETERMINATION THAT THE ZONING
TEXT AMENDMENT IS STATUTORILY EXEMPT FROM CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)
PURSUANT TO CEQA GUIDELINES SECTION 15282(h)
The Ordinance will amend the Milpitas Municipal Code related to accessory dwelling units to comply with
Government Code Sections 65852.2 and 65852.22 and include revisions not required by state law, but introduced
to further encourage the production of accessory dwelling units. Adoption of the Ordinance is statutorily exempt
from environmental review pursuant to Sections 15282(h) of the CEQA Guidelines (adoption of an ordinance
regarding second units in a single-family or multifamily residential zone by a city or county to implement the
provision of Sections 65852.1 and 65852.2 of the Government Code as set forth in Section 21080.17 of the Public
On February 13, 2019, the Milpitas Planning Commission adopted Resolution No. 19-006 recommending that the
City Council adopt proposed Ordinance No. 38.8333.
NOTICE IS FURTHER GIVEN, pursuant to CA Government Code §65009, that any challenge of these matters in
court may be limited to raising only those issues raised at the public hearing on April 16, 2019 or in written or
e-mailed correspondence delivered to the City Council at, or prior to, this hearing.
ANY PERSONS who wish to comment are encouraged to attend the public hearing or to submit written comments
